New Unfair Terms Legislation planned for January 2010

Chris Bowen today announced that the Commonwealth unfair terms law will be fast tracked and brought in on 1 January 2010.  It will apply to standard form contracts.  A discussion paper is being released and legislation will be introduced in the first half of this year.

See also speech to Monash Centre for Regulatory Studies delivered today (17 February) entitled Australian Consumer Law – The Future in which Chris Bowen proposes – among other things – renaming the Trade Practices Act the ‘Australian Competition and Consumer Act’ (from TPA to ACCA????).

A press release has now been issued and the consultation paper is now also available.  They’ve given us a whole month to work through the 136 page document; submissions are due by 17 March 2009.
